Acceptance of terms
By accessing or using DoesItHaveIt? ("the Service") at doesithaveit.com, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the Service. These Terms constitute a binding agreement between you and JustWhat LLC ("Company," "we," "us," "our"), a Colorado limited liability company.
Description of service
DoesItHaveIt? is an address intelligence platform that aggregates publicly available and licensed data (utilities, internet providers, building permits, transit, demographics, and more) to help individuals and businesses make address-related decisions. The Service is currently available for addresses in Colorado. Coverage, accuracy, and availability may vary.
Accounts and eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You agree to provide accurate, current, and complete information and to update it promptly if it changes.
One person may not maintain multiple accounts to circumvent plan limits or abuse trial offers. We reserve the right to terminate duplicate or fraudulent accounts.
Subscriptions and billing
Plans. We offer Free, Upgrade, Premium, and Premium Plus plans with different feature sets. Plan details, pricing, and included features are described on the Pricing page and are subject to change with reasonable notice.
Free trial. Paid plans include a 14-day free trial. No payment is collected during the trial. If you do not cancel before the trial ends, you will be charged at the plan's regular rate.
Billing cycle. Subscriptions are billed monthly or annually (your choice) and renew automatically. You authorize us to charge your payment method on each renewal date.
Price changes. We may change subscription prices with at least 30 days' notice sent to your account email. Continued use after the effective date constitutes acceptance.
Refunds. We offer a full refund within 7 days of the first charge if the Service did not meet your expectations. After that period, refunds are granted at our discretion. Contact billing@doesithaveit.com.
Acceptable use
You agree not to: (a) use the Service in violation of any law or regulation; (b) scrape, crawl, or automatically extract data beyond what the Service expressly allows; (c) resell, sublicense, or redistribute the Service or its data without written permission; (d) attempt to reverse-engineer, decompile, or bypass security measures; (e) use the Service to harass, harm, or discriminate against individuals; (f) impersonate another person or entity; (g) introduce malware, viruses, or other harmful code; or (h) abuse trial offers, create fake accounts, or interfere with other users.
We reserve the right to suspend or terminate your account for violations without refund.
Intellectual property
All software, trademarks, trade dress, data compilations, and content on the Service are owned by or licensed to JustWhat LLC and are protected by copyright, trademark, and other laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your personal or internal business purposes. No other rights are granted.
If you submit feedback, bug reports, or feature requests, you grant us a perpetual, royalty-free license to use that feedback to improve the Service.
Third-party data and services
The Service aggregates data from third-party sources including public datasets, government agencies, county sources, and commercial APIs such as official federal, state, and county records, commercial place and event data, live environmental and infrastructure feeds, and our own proprietary monitoring and scraper network. We do not guarantee the accuracy, completeness, or timeliness of third-party data. Third-party service providers have their own terms, and your use of certain features may be subject to those terms.
Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JUSTWHAT LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF $100 USD OR THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.
Indemnification
You agree to indemnify, defend, and hold harmless JustWhat LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Service, your violation of these Terms, or your violation of any third-party right.
Termination
You may cancel your account at any time from Dashboard → Billing. We may suspend or terminate your access for violation of these Terms, non-payment, or for any reason with reasonable notice. Upon termination, your right to use the Service ceases immediately. Provisions that should survive termination (limitation of liability, IP, governing law) do survive.
Governing law and disputes
These Terms are governed by the laws of Colorado, USA. Any dispute will first be addressed through good-faith negotiation. If unresolved, disputes will be settled by binding arbitration under the AAA Commercial Arbitration Rules in Denver, Colorado. You waive any right to a jury trial or class-action participation. Either party may seek emergency injunctive relief in a court of competent jurisdiction.
Changes to these terms
We may modify these Terms at any time. We'll provide at least 14 days' notice of material changes via email or an in-app banner. Continued use after the effective date constitutes acceptance. If you disagree with changes, cancel your account before they take effect.
